1. Who we are
Kalaavid ("we", "us") operates the kalaavid.com marketplace connecting clients who want to commission art with artists who make it. By using the site you ("you") accept these terms.
2. Accounts
You must be 18 or older. You provide accurate signup information. You're responsible for the security of your account and password. One person, one account. We may suspend or terminate accounts that violate these terms.
3. Roles
Accounts are either Client or Artist at signup. Roles are role-specific and not interchangeable — if you need both, contact us. Artist profiles are public; client profiles are private.
4. Content & ownership
Artists retain copyright in all work they create unless explicitly assigned in writing as part of the brief. By posting a portfolio item or brief, you grant Kalaavid a non-exclusive licence to display it on the platform for purposes of operating the marketplace. We will never use your work to train AI models.
5. Payments & commission
Payments are processed by Stripe. We hold milestone funds in escrow on the platform balance and release them to the artist's connected Stripe account upon your approval. Our commission is 15% on commissions under $5,000 CAD, and 10% at or above that threshold, snapshotted at contract signing. Stripe's standard processing fee is absorbed by Kalaavid out of our commission; Stripe's FX conversion fees apply on cross-currency transactions.
6. Refunds & cancellations
A held milestone (funded but not yet approved) can be refunded — to request a refund or to cancel a contract before final approval, email support@kalaavid.com and we'll process it within 2 business days. Once a milestone is approved and released, the funds belong to the artist and the transaction is one-way. Disputes are handled per Stripe's dispute process; we may participate in evidence submission as the platform of record.
7. Anti-circumvention
Don't use the platform to find a counterparty and then take payment off-platform to avoid our commission. We auto-redact emails, phone numbers, and external links in messaging precisely to protect both sides — bypassing this defeats the buyer protection. Repeated attempts may terminate your account.
8. Prohibited content
No illegal content, no minors in sexualised contexts, no content that infringes third-party rights, no harassment, no impersonation, no fraud. We reserve the right to remove content and suspend accounts at our sole discretion.
9. Liability
Kalaavid is provided "as is". We make no warranty about uptime, results, or fitness for a particular purpose. Our total liability to you for any claim related to the service is limited to the commission we've collected from you in the prior 12 months.
10. Governing law
These terms are governed by the laws of Ontario, Canada. Disputes that can't be resolved informally will be heard in Toronto, Ontario, except where local consumer-protection law gives you a non-waivable forum.
11. Changes
When we change these terms we'll update the date and notify active users for material changes. Continued use means you accept the updated terms.
